YOUR RIGHTS UNDER CALIFORNIA LAW
California Pregnancy Disability Leave Law
Under California Pregnancy Disability Leave Law (PDLL), you have the right to take up to 4 months of leave if you are disabled by your pregnancy or a related condition that requires you to take light duty or bed rest.
You can take this time all at once or do it intermittently as needed for as little as one week or one hour if you are suffering from complications, a need to recover or to attend prenatal visits.
Your employer is also obligated to provide you with a reasonable accommodation regarding your pregnancy or complications including transfer to a less strenuous job, if available.
Be aware that you must give notice of your intention or need to take leave at least 30 days before your leave is to be taken.
Notice may be oral or in writing. If advance notice is not possible due to an emergency or other change in circumstances, you may still be entitled to leave so long as you promptly notify your employer when feasible. Your employer may require you to obtain a medical certificate from your health care provider to support your request.
California Family Rights Act
You also have the right to take an additional 12 weeks off once you have given birth under the California Family Rights Act (CFRA), depending on how long you have been with your employer and certain other conditions including the size of your company. Your health insurance and other benefits, including accrual of seniority, must be continued while you are on leave.
California Fair Employment and Housing Act (FEHA)
You are also protected by the FEHA from being demoted, terminated, harassed or otherwise penalized for being pregnant, giving birth or requesting and going on maternity leave.
